He's in a public place known to house cameras which rove the crowd so there's no invasion of privacy and opinion (by the commentators) is not actionable defamation. Maybe he's hoping ESPN will pay him rather than their lawyers.

If you ever read the fine print on a baseball ticket, by using the ticket you basically agree to waive any rights to damages from injuries resulting from batted balls etc.

I wonder if there is any similar legalese pertaining to the use of your image by any media covering the game.

The Yankee defense can be that they hire fatsos, too. Just look at Sabathia and Hideki Irabu.

I think it depends what, if anything, the sportscasters said while the camera rested on him. They're invariably polite, and usually would say something mild like, 'someones having an afternoon siesta.'

Well he probably won't win but I doubt that's the point. He wants to make them sweat. Maybe they'll fire the announcers, depending on what they actually said. They'll offer him a small amount to make the nuisance suit go away and maybe he'll hurt the guys who used him to get their kicks.

People got no judgement these days.
